Potts Director SUBJECT: Annual Agency Ethics Training Plans Consistent with the Office of Government Ethics' (OGE) memorandum dated July 6, 1995 (DAEOgram DO-95-028), agencies are not required to submit an annual agency ethics training plan for calendar year 1997. However, agencies are still required to develop an annual ethics training plan for calendar year 1997 and maintain it at the agency to comply with the requirement found at § 301(c) of Executive Order 12674, as modified by Executive Order 12731. This plan should have been completed by January 1, 1997. Additionally, § 301(c) of Executive Order 12674 also requires agencies to coordinate with OGE in developing the annual ethics training plan. Such coordination can include: consulting with OGE concerning new OGE training materials, contacting the Ethics Information Center or consulting with OGE concerning other issues or problems an agency is facing in providing training. As a reminder, OGE's Program Review Division will be verifying that ethics training plans have been developed in accordance with the requirements found at 5 C.F.R. § 2638.702 for the calendar year in which the review occurs. OGE anticipates publishing amendments to the training regulation found at 5 C.F.R. part 2638 within the next few months. Among other things, these amendments will eliminate the requirement for agencies to submit their annual ethics training plans to OGE but will retain the requirement that agencies must develop an annual ethics training plan and maintain the plan at the agency.
